Guevarra: Chiong Sisters convicts could benefit from GCTA for "Good Behavior"


The men convicted for the 1997 abduction and rape of sisters Marijoy and Jacqueline Chiong in Cebu could benefit from the adjusted good conduct time allowance (GCTA), according to Justice Secretary Menardo Guevarra.

In a report on Balitanghali on Friday, Guevarra said the convicts could be released from prison as long as they meet the requirements set by Republic Act 10592, which recomputes the duration of imprisonment based on an offender's good conduct.


Among the convicts is Francisco Juan "Paco" Larrañaga, who is currently serving his sentence in Spain through its Transfer of Sentence Agreement with the Philippines because of his dual citizenship.

Despite this, Guevarra said Philippine law will still be followed in the case of Larrañaga. "Yung substantive law na maggo-govern ay still Philippine law," he said.

"In my opinion, he can still benefit because he was tried, prosecuted and sentenced under Philippine law," Guevarra added.


Guevarra, however, could not name the other convicts in the high profile crime who could benefit from the GCTA.

Larrañaga and six others were convicted of kidnapping, illegal detention, rape and homicide in connection with the rape and death of the Chiong sisters.

The six others convicted of the Chiong rape-murders are Josman Aznar, Rowen Adlawan, Alberto Cano, Ariel Balansag, James Anthony Uy and his brother James Andrew. —KBK, GMA News
